These Terms of Use (“Terms”, Algemene voorwaarden) govern access to and use of the website sprouteuwipe.world operated by Sprouteuwipe.ddd (“we”, “us”). By using the site, you agree to these Terms. If you do not agree, please discontinue use.

These Terms are drafted in plain language as required for transparency under Dutch consumer law. Where you qualify as a consumer (consument) under the Dutch Civil Code (Burgerlijk Wetboek — BW), mandatory consumer protections prevail over conflicting clauses in these Terms.

2. Nature of Content and Services

All articles, guides, calculators, event descriptions, and community suggestions provide general lifestyle information only. They are not professional, medical, psychological, or therapeutic advice. Content does not create a clinician–patient, therapist–client, or advisor–client relationship.

We do not sell goods or paid subscriptions through this website. Community events listed on the site are generally free informational gatherings unless explicitly stated otherwise. No online payment is processed on this site.

3. Acceptable Use

You agree not to:

• Use the site unlawfully or in ways that harm others, our infrastructure, or third parties;
• Scrape, automate access, or attempt unauthorised data extraction beyond normal browsing;
• Misrepresent affiliation with us or reproduce content without permission except as permitted by mandatory law (e.g. quotation rights under the Dutch Copyright Act — Auteurswet);
• Submit false, offensive, discriminatory, or unlawful material via contact forms;
• Upload malware or interfere with site security.

We may restrict access if these rules are violated.

4. Events and Community Activities

Events are informal educational meetups, not clinical or medical services. Participation is voluntary and at your own risk. Follow Health & Safety guidelines on the site. We may cancel or reschedule events; registered participants with valid contact details will be notified.

Registration via the contact form does not create a paid contract unless we explicitly confirm otherwise in writing.

5. Intellectual Property

Text, graphics, logos, layout, and design are protected by copyright and related rights under the Auteurswet. You may view and print pages for personal, non-commercial use. Republication, commercial exploitation, or modification requires prior written consent, except where mandatory law allows limited use.

Trademarks and domain names remain our property or that of respective owners.

6. Third-Party Links and Embeds

The site may include Google Maps embeds, external links, or references. We are not responsible for third-party content, availability, or privacy practices. Review their terms and policies separately. Third-party services may process personal data under their own legal bases.

7. Privacy and Cookies

8. Limitation of Liability

To the fullest extent permitted by Dutch law:

• Our aggregate liability for direct damage arising from an attributable failure in the performance of our obligations is limited to €100, except where limitation is not permitted by mandatory law;
• Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, intentional misconduct, or fraud;
• We do not guarantee uninterrupted or error-free operation of the website.

As a consumer, you retain rights under Title 5, Book 6 BW and other mandatory Dutch consumer legislation that cannot be waived by contract.

Individual experiences with dietary changes vary. We make no guarantees regarding outcomes.

9. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including outages, natural events, government measures, or third-party service failures, provided we notify you where reasonably possible.

10. Complaints Procedure

If you have a complaint about our website, content, or handling of personal data:

1. Contact us at message@sprouteuwipe.world or via the contact form, describing your concern clearly;
2. We aim to respond within 14 business days with an acknowledgement and, where possible, a substantive reply;
3. If your complaint relates to personal data, you may also contact the Autoriteit Persoonsgegevens (AP);
4. Consumer disputes about commercial practices may be reported to the Autoriteit Consument & Markt (ACM) where applicable.

11. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent court in the district of Amsterdam (Rechtbank Amsterdam), unless mandatory EU consumer law grants you the right to bring proceedings in your country of residence.

We are not obliged to participate in a statutory dispute resolution body (geschillencommissie) for free lifestyle content, but we will review complaints in good faith and seek amicable resolution where possible.

We may update these Terms to reflect legal, technical, or operational changes. The “Last updated” date will change. Material changes affecting consumers will be communicated on this page before taking effect where reasonable. Continued use after the effective date constitutes acceptance where permitted by law.

13. Severability

If any provision of these Terms is held invalid or unenforceable under Dutch law, the remaining provisions remain in full force. The invalid provision shall be replaced by a valid provision that achieves the original purpose as closely as possible.
